Limited License to Construct – It is Jim Phelps Signature Collection’s intent to create unique one-of-a-kind home plans for our customers. Great care and meticulous attention to detail are evident in the design of our homes.  In an effort to protect the home’s uniqueness in the area it is being built, we monitor and limit the availability of all plan sales. That is, Jim Phelps Signature Collection reserves the right to deny the sale of plans within zip codes where the homes have already been built (or purchased for construction). When placing an order the purchaser will be asked the city, state and zip code he will be constructing the home. This information will be documented in our records and should someone else request to purchase the same plan, with the intent to build in the same zip code, that request will be denied. Although it is impossible to guarantee someone will not build without a license granted by Jim Phelps Signature Collection, we carefully monitor all plan sales in an effort to protect the individuality of our customers’ homes.

Each plan purchase is granted a one-time limited license use privilege. The purchaser is allowed to construct only one home from the plans. This license does not transfer the ownership of these plans to the purchaser. The plans are owned and copyrighted by Jim Phelps Signature Collection and cannot be resold, transferred or held in the possession of anyone other than the original purchaser. Although plans may be loaned to applicable parties involved in the construction of the home, upon completion of construction all plans must be retrieved by the original purchaser. If you suspect a third party has taken unauthorized possession of or constructed from your plans please contact Jim Phelps Signature Collection immediately.

Single-Use – The purchase of any Jim Phelps Signature Collection plan grants a single-use privilege only. That is, the purchaser is granted a limited license to construct only one home from the plan in the geographical area registered by the purchaser. Multiple construction of the plan requires authorization and the appropriate license must be obtained from The Jim Phelps Signature Collection.

License to Modify – Each plan is accompanied by a Limited License for Construction. This permits the purchaser to modify the plan as necessary to meet design needs, code compliance and site/jurisdiction requirements. Only a design professional is authorized to modify the plan and therefore accepts full responsibility for the accuracy and integrity of the modified plan.The Jim Phelps Signature Collection will not be responsible or liable for any modifications made to the plans. Both vellums and CAD files are modifiable.

Reproduction – The purchaser is granted authorization to reproduce and/or copy the plan set to facilitate the construction of the home. The purchaser is responsible for the safekeeping of the original plan and all reproductions of the plan. When the construction process is completed, the purchaser must retrieve all loaned plans and keep them in his possession.

Construction – Each plan set contains sufficient information for the construction of the home as designed by The Jim Phelps Signature Collection. In most cases plans will include foundation plan, floor plans and elevations, framing plan, sections and details, roof plan, door and window schedules and electrical plans. (Plumbing and mechanical plans are not included.) The Jim Phelps Signature Collection is not responsible and assumes no liability for the construction of the home. The purchaser and/or builder shall assume full responsibility for the home constructed from the plan as well as the accuracy of dimensions, code compliance and site/jurisdiction requirements.

The structure of the home is designed using the 2000 Edition of the International Residential Code. The loads applied are indicated on the standard notes page in the construction documents. Specific jurisdictions may require more or less stringent application of load. Check with your local code official to determine if further review of the structural layout is required by a professional engineer in your jurisdiction.

Exclusivity – The purchaser is granted exclusive use of the plan in the geographical area registered by the purchaser. The Jim Phelps Signature Collection will record the construction zip code and will deny the sale of the plan to any person requesting to build in the same zip code.

Copyright – The purchase of a plan does not transfer the ownership of the plan to the purchaser. All plans are owned and copyrighted by The Jim Phelps Signature Collection and cannot be resold, transferred or held in the possession of anyone other than the original purchaser. The plan may be loaned to applicable parties involved in the construction of the home, however, upon completion of construction the plan must be retrieved by the original purchaser.
